Too keep it simply short. I traded a 97 Jeep with 200,000 miles on it for a 2001 Honda with 200,000 miles on it. The Jeep had problems as well as the car. I stated only the problems I knew about. Today he said the transmission don't work which well I drove it off the trailer with my father into his yard and we traded, signed titles, bill of sales and left. Neither one of us Test drove vehicle. I was buying and selling (trading) As-Is. both vehicles need the same amount of work. The first thing I said was Jeep is not pretty it needs work I don't know what's al wrong I just listed what I knew.

So he calls and stated more problems each day ( I didn't even go into the cars problems because I'm not like that. It was a fair trade for me. I was looking for a small car and him a Jeep.) now he says Jeep don't run and he's coming to get his car. Well i told him problems with car which he denied. So he called me a liar and cheater and if he don't get his car then he will see me soon, that karma is a MFer. (This guy is crazy) I sold him car as-is. We each have signed documents and under price (because we didn't know what to put we put he sold his for 500$ and I sold mine for 500$ so like an even trade which it was. He keeps harassing me that he's gonna come do something about this and I mentioned if he wanted to go to court that's fine but he said he won't need court that's not necessary and he will see me soon.

Is there laws stating I don't have to trade back?

Lemon laws only apply to brand new cars, not used cars. So, whose names are on the titles right now? The person whose name is on the legal title is the owner of the at this point --- until each of you goes to the DMV and gets a new title in your name. You'll also need to pay sales tax and registration/tag fees -- and show proof of insurance at that time.



This guy might be a threat to your safety. Keeps notes of his calls and what he's said. At some point you should call the cops and report him for threatening you and harassing you, both of which are against the law.

If he is threatening you with physical harm, call the police. Used car sales between private parties are considered to be AS-IS unless there is a contact to the contrary. If he calls again inform him that any further contact will be considered harassment and you WILL press charges against him.



You do not have to trade back, the deal is done and he has no legal ground to force anything

Call the police and report the threats, no lemon laws for used cars sold privately or traded. Keep the car locked up, or put a club on it, sounds like hes gonna take it back. Also go get it titled in your name right away so he doesn't file for lost title.

Lemon laws protect the buyer's of new cars from serious, recurring defects. There is no protection for old used cars. You don't have to trade back. It's no different than if you sold him the car, they were traded "as is".
